The Supreme Administrative Court (SAC) of the Republic of Bulgaria has put an end to a long-standing commercial legal dispute by issuing a final decision in favor of Geotron Engineering Ltd. The supreme court act completely overturns a previous decision of the Commission for Protection of Competition (CPC) and categorically confirms that the company develops its activities in full compliance with fair commercial practice and the laws of the country.
The proceedings were initiated upon a request and subsequent cassation appeal by the competing company "Re Energy Engineering" EOOD,but the case was analyzed in detail and their claims were rejected by two court instances. In its final decision, the Supreme Administrative Court did not accept the arguments of "Re Energy Engineering", fully accepting the arguments of the defense of "Geotron Engineering". The court emphasized that the engineering of complex, closed geothermal systems and heat pump wells is a highly specialized activity, in which the leading factor is real technical competence, not administrative formalism.
The court explicitly recognized that the over 15 years of professional experience of the leading engineers in the Geotron Engineering team, including the large-scale projects they have implemented over the years, legitimately constitute the capacity on which the company's activities are built. In their reasoning, the supreme judges point out that the unification of resources, equipment and personal expertise in the structure of Geotron Engineering is a real economic fact that guarantees competent and professional performance to clients.
